Terms of service

These Terms of Service (“Terms”) apply to purchases made through the KINDAMATO website.

KINDAMATO is a trading name of Saxon Group Limited, a company based in Hong Kong.

By placing an order through our website, you agree to these Terms. Please read them before making a purchase.

Nothing in these Terms affects any rights you have under applicable consumer law.

1. About Us

The KINDAMATO online store is operated by:

Business name: Saxon Group Limited
Trading as: KINDAMATO
Email: hello@kindamato.com
UK VAT number: 524573684

You can also contact us through the Contact Form on our website.

2. Products

We try to describe and display our products as accurately as possible.

Colours may appear slightly different depending on your screen or device. Product measurements are approximate, and small variations may occur between individual garments or during production.

These reasonable variations do not affect your rights where a product is faulty, damaged or materially different from its description.

Please check the relevant product description and size guide before ordering.

3. Prices

Prices are displayed in the currency applicable to the market you are shopping in.

Prices and applicable taxes will be shown before you complete your purchase. Shipping charges and, where applicable, information about duties, taxes or import charges will be shown or explained before checkout is completed.

We may change our prices at any time, but a price change will not affect an order that we have already accepted.

If a pricing error is obvious and could reasonably have been recognised as an error, we may cancel the affected order and issue a full refund.

4. Orders

After you place an order, you will receive an order confirmation.

An order confirmation acknowledges that we have received your order. It does not necessarily mean that the order has been accepted.

Your order is accepted when we confirm that the order has been dispatched, unless we tell you otherwise.

We may decline or cancel an order before dispatch if, for example:

  • an item is unavailable;
  • there is an obvious pricing or product information error;
  • payment cannot be authorised;
  • we reasonably suspect fraud or misuse of the website; or
  • we are unable to deliver to the address provided.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item or order.

5. Payment

Available payment methods are shown at checkout.

You confirm that you are authorised to use the payment method provided for your order.

Payment processing may be carried out by third-party payment providers and may be subject to their own terms and security procedures.

We do not receive or store your complete payment card details where these are processed directly by an authorised payment provider.

6. Shipping and Delivery

Orders are dispatched from Hong Kong unless otherwise stated.

The destinations we currently ship to, shipping methods, charges and estimated delivery times are described in our Shipping & Returns Policy and at checkout.

Delivery dates are estimates unless we expressly agree otherwise.

We are not responsible for delays caused by circumstances outside our reasonable control, but this does not affect any rights you may have under applicable consumer law.

If a delivery problem occurs, please contact us so that we can investigate it.

7. Taxes, Duties and Import Charges

Taxes, duties and import charges will be handled in accordance with applicable law and the information shown at checkout or in our Shipping & Returns Policy.

Where an amount is legally required to be collected by us at the time of purchase, we will collect it as part of the transaction.

Where import charges are payable separately by the recipient, this will be explained where applicable before purchase.

8. Cancellations, Returns and Refunds

Our cancellation, return and refund arrangements are set out in our Shipping & Returns Policy.

Nothing in that policy or these Terms limits your statutory consumer rights.

In particular, customers purchasing online may have additional cancellation and return rights depending on where they live.

For UK customers, statutory rights relating to distance purchases apply, including the applicable right to cancel eligible purchases within the legal cancellation period. GOV.UK

12. Our Responsibility to You

We are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for losses that were not reasonably foreseeable when the contract was formed.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence.

Nothing in these Terms excludes or limits any mandatory consumer rights available to you.

13. Privacy

We handle personal information in accordance with our Privacy Policy.

Where applicable, you can also manage your cookie preferences through the cookie controls available on our website.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes to our services, business practices or applicable legal or regulatory requirements.

The most current version will be available on this page.

Material changes will be communicated where required by law.

Changes will apply from the effective date of the updated Terms and will not normally affect orders placed before that date.

15. Governing Law

These Terms are governed by the laws of Hong Kong.

However, if you are a consumer living in another jurisdiction, including the United Kingdom, you continue to benefit from any mandatory consumer protections provided by the laws applicable to you.

Nothing in this section prevents you from exercising any rights regarding jurisdiction or dispute resolution that cannot legally be excluded.
